1. Scope and the parties
These terms apply to Krokus platform services, including krokus.tt, Krokus-hosted store subdomains and connected store domains. Any subscription agreement, accepted fee schedule and store-specific terms disclosed for a transaction also apply to the relevant service. Mandatory consumer and privacy rights always take precedence over a conflicting provision.
Unless a listing or order expressly identifies SOLEYA Consulting Ltd as the seller, the store business is the seller of its goods and is responsible for the listing, product quality, availability, legal compliance, customer service and its fulfilment obligations. Krokus provides platform and administrative services and may coordinate payment, delivery, approvals or credit. These roles do not remove any responsibility imposed on Krokus by applicable law.
A store's terms must be available before purchase and cannot override Krokus platform rules or mandatory law. An existing order is governed by the terms and pricing properly disclosed and applicable when it was placed, subject to a later lawful agreement with the affected parties.
2. Accounts and permitted use
You must provide accurate information, have authority to act for any business you represent, and protect credentials and verification codes. Business-account holders must be at least 18 and able to enter a binding contract. A person unable to enter a purchase contract independently must act through a parent or guardian.
Do not use Krokus for fraud, unlawful or misleading sales, infringement, harassment, malicious uploads, unauthorised access, attempts to obtain another store's private information, or activity that interferes with the service. Do not generate artificial advertising impressions or clicks, ask others to click ads to support your store, or click your own ads.
Tell us promptly about suspected account compromise or inaccurate account information. You are responsible for actions you authorise and for managing staff access; responsibility for unauthorised activity will be assessed in accordance with applicable law and the circumstances.
3. Orders, approval and availability
An order submission is a request to purchase. A reference number, acknowledgement or appearance in a management screen does not itself confirm payment, availability or delivery. Refer to the separate approval, payment and fulfilment statuses and any confirmation sent for the order.
A payment method may require approval by Krokus platform administration before the order can proceed. An authorised administrator may approve or reject the order after reviewing the applicable information and fees. Approval is separate from payment confirmation and does not mean an order is paid or delivered.
Products, variations and prices may change before an order is placed. If a material error, shortage or change is discovered afterwards, the store or Krokus must explain the proposed resolution. A higher customer charge or material substitution must not be imposed silently; any required agreement must be obtained, and cancellation or another remedy offered where required by law.
4. Prices and payment
Krokus selling amounts are in Trinidad and Tobago dollars (TTD), commonly shown as TT$. The checkout breakdown identifies the product amount, taxes where applicable, delivery charge, customer service fee and credits applied. An abbreviated currency display does not change the underlying order currency.
Pay only through the instructions or provider identified for your order. Selecting a payment method or sending a reference does not itself verify that funds were received. An authorised administrator or connected payment provider records confirmation as appropriate. Processing and confirmation can take time.
Payment providers, banks and delivery providers may impose their own disclosed terms or charges. Krokus does not guarantee acceptance by a provider. If you believe a charge or payment status is wrong, contact the store and Krokus with the order reference and appropriate evidence, excluding passwords and card security codes.
5. Delivery and fulfilment
Provide a complete delivery address and reliable contact information. Delivery availability, collection arrangements, service conditions and estimated timing depend on the selected store and service. An estimate is not a guaranteed delivery time unless expressly agreed.
During fulfilment, the store may review product lines, record actual supplied quantities and note discrepancies. These records help explain revised totals, customer remedies and store proceeds. A fulfilment record is not a waiver of a customer's right to dispute missing, damaged or incorrect goods.
Report an issue promptly to the store with the order reference, affected products and supporting information. Keep relevant receipts and delivery evidence. A store's disclosed returns process may apply, subject to the rights and remedies required by law.
6. Cancellation, rejection and refunds
A customer can request cancellation using an available order action or by contacting the store and Krokus. Whether cancellation can be completed depends on payment, preparation, dispatch, any agreed terms and applicable law. A cancellation request alone does not confirm that an order or payment has been reversed.
The store or platform administration may cancel or reject an order for reasons such as unavailable goods, inability to deliver, unresolved payment, a material listing error, suspected fraud or unlawful activity. The actor, reason and relevant status changes should be recorded for investigation and customer service.
When payment has already been received, cancellation, rejection or an unresolved shortage must have an appropriate refund, credit or other resolution consistent with the customer's legal rights and any lawful agreement. Timing may depend on a payment provider. Store credit or a gift card must not replace a cash or original-payment refund where the customer is legally entitled to that refund and has not lawfully agreed otherwise.
Contact the store first for product, delivery and return issues. Contact Krokus for platform-payment, approval or credit-record issues, or if a store does not resolve the matter. Nothing here restricts a lawful chargeback, complaint or statutory remedy.
7. Fulfilment adjustments, store credit and gift cards
A recorded shortage can reduce the order total and create a customer-credit amount. The original and revised values, affected line items, notes and issued credit are retained for audit, disputes and payment enquiries. Delivery and other fees are not automatically reduced merely because product quantities are lower; any adjustment remains subject to the disclosed terms and applicable law.
Store credit belongs to the customer who placed the order and is usable only at the original store. A Krokus gift card is an alternative credit usable at participating Krokus stores where the service is supported. Account ownership, available balance, currency, reservation and verification checks may apply to redemption. Protect credit codes and report unauthorised use promptly.
The configured gift-card minimum determines when a Krokus gift card is available as an option. It does not impose an upper limit on store credit and does not force the customer to take a gift card. A gift-card service charge is payable by the store according to its applicable fee policy; it must not reduce the customer's discrepancy-credit entitlement.
Do not assume a credit is transferable, redeemable for cash or has a particular expiry unless the terms supplied with it or applicable law provide that right. Any material restrictions must be disclosed before acceptance. Keep the order reference so a credit or balance dispute can be investigated. If a store closes or a redemption service is unavailable, contact Krokus for review; these terms do not promise an unconditional guarantee of another business's liabilities.
8. Business fees, approval and settlement
For business users, the applicable subscription agreement and fee policy determine platform charges, commission, delivery and customer-service-fee allocation and settlement. A policy may specify fixed amounts or percentages and effective dates. The store is responsible for reviewing the applicable schedule and approved order breakdown.
Before approving an order, Krokus administration may review and adjust the store fee in accordance with the store's agreed fee arrangements and the applicable order policy. Store-paid charges and approved store-fee adjustments are borne by the store and may be deducted from its proceeds. They must not silently increase the customer's agreed total. An adjustment should have a recorded reason and be available for review.
Delivery and customer service fees may contain separate Krokus and store portions. Those allocations are distinct from the store commission. The Krokus portion, store-paid gift-card service charge, customer-credit obligations and other properly agreed deductions affect the store's net proceeds. A displayed proceeds figure is not, by itself, proof of a completed payout.
A new fee policy must identify when it takes effect. It must not be silently backdated to a completed checkout. A lawful correction or later adjustment must preserve an explanation and any required authorisation. Raise a disputed store charge with Krokus promptly so the order, policy and audit records can be reviewed.
9. Store subscriptions and advertising
Store features and advertising eligibility depend on the subscription tier and current configuration. Where enabled under the applicable plan, labelled advertisements may appear as product-grid tiles or rows between results. Advertising is not an endorsement by Krokus or the store, and an advertiser's offer is separate from the store's products.
Krokus can configure the ad formats available to each tier and disable advertising for operational or policy reasons. A materially changed paid-plan entitlement or fee must be handled under the relevant agreement, with notice and any consent or remedy required by law. No store is promised a particular advertising fill rate, Google approval or advertising income unless separately agreed.
Advertising, cookies and optional data uses are described in the Privacy Policy and applicable consent controls. Agreement to these terms is not consent to personalised advertising. Store owners must not obscure ad labels, disguise ads as buy buttons or otherwise encourage invalid clicks.
10. Store content and customer information
You retain rights in content you lawfully provide. You grant Krokus the permissions reasonably necessary to host, display, reproduce for delivery and backups, and process that content to operate the services you request. You must have the rights to upload it and must not publish private customer information in public listings or pages.
Businesses must use customer information only for lawful, disclosed purposes, maintain appropriate staff access and privacy notices, honour applicable privacy requests and obtain any consent required for their own marketing or tracking. Access to an order is not permission to add that customer to unrelated marketing lists.
Krokus may access store data for authorised administration, support, security, recovery, compliance and dispute resolution. Each party must comply with the privacy responsibilities applicable to its own activities. The Privacy Policy explains platform data handling; separate written data-processing terms may be needed for a particular business relationship.
11. Suspension, closure and databases
We may restrict access where reasonably necessary for security, unlawful activity, material breach, unresolved contractual obligations or a lawful request. Where practicable and appropriate, we will explain the restriction and give an opportunity to resolve it. An urgent security measure may be taken first.
Business-account deletion is separate from database and uploaded-file deletion. Closing an account can disable its routes while retaining an unassigned database, files, backups and necessary order or credit audit records. Contact Krokus to arrange any permitted export, deletion or recovery. Retention and privacy rights remain governed by the Privacy Policy and applicable law.
Database reassignment must be specifically authorised by the appropriate business and reviewed for customer-data ownership and lawful transfer. Replacing an account's linked database does not itself authorise access to another business's confidential records or erase the displaced database. Retained data must remain protected.
12. Availability and responsibility
We aim to keep Krokus usable and secure, but maintenance, outages, network failures and third-party services can interrupt access. No promise of uninterrupted operation, error-free listings or absolute security is made. Businesses should maintain appropriate records and report suspected service errors.
Each party is responsible for obligations imposed on it by law and by the agreements that apply. Nothing in these terms excludes liability for fraud, deliberate wrongdoing or any liability that cannot lawfully be excluded, or removes non-waivable consumer rights. Any separately agreed limitation of business liability applies only to the extent legally permitted.
13. Changes, disputes and contact
We may update these terms for changes to the service or legal requirements, showing a new effective date. Material changes will receive additional notice or require agreement where appropriate or legally necessary. Publishing a revised page does not itself rewrite the price, credit entitlement or terms of an existing order, and does not establish that a user accepted a new charge.
These terms are governed by the laws of Trinidad and Tobago to the extent permitted by applicable law. This does not remove mandatory protections or access to courts or regulators available to a consumer in another jurisdiction. Contact us first so we can try to resolve a dispute; this is not a waiver of legal remedies or a mandatory arbitration requirement.
For platform questions, disputes, privacy requests or policy enquiries, contact SOLEYA Consulting Ltd, operator of Krokus, at [email protected]. Include the relevant store and order or account reference, but do not send passwords or complete card details.
